Many people believe they can only
qualify for Medi-Cal (Medicaid in other states) and have help
paying for nursing home expenses if they first become
impoverished. However, many years ago Congress passed legislation
specifically designed to avoid the impoverishment of the spouse of
a nursing home resident when the well spouse is still living at
home.
In assisting our clients with Medi-Cal
applications and asset preservation planning, we provide advice on
what they can do to qualify for Medi-Cal benefits and, at the same
time, preserve the assets which they have worked all of their
lives to accumulate.
We often find that there are many
misconceptions about the Federal Medicaid law and in particular
its implementation under California's Medi-Cal system which is
very complex. In advising our clients concerning preservation of
their assets we can also review what may be done to avoid a
recovery claim by Medi-Cal following the death of the benefit
recipient.
